Once a product is so designated, procuring agencies are required to purchase it with the highest recovered material content level practicable.

1. EO 13423 requires Federal agencies to ensure that 95% of new contract actions, including task and delivery orders, for products and services are biobased where such products and services meet agency performance requirements.
2. EO 13514 requires Federal agencies to purchase “green” goods and services, to include recycled content and biobased products, energy and water efficient products, and environmentally preferable products as determined by the USDA.
3. 2008 Farm Bill Section 9002 requires federal agencies to purchase biobased products designated as BioPreferred.
